1. Who we are and what these Terms cover
TopMonie is a technology platform operated by Profynix Technology. These Terms form a contract between you and Profynix Technology when you create or use a TopMonie account.
TopMonie is not a bank. Regulated account, payment-processing, transfer and bill-payment services are supplied through third-party financial and service partners. The provider used for a service may be shown in the app or on a receipt.
2. Eligibility and account opening
You must be at least 18 years old, legally capable of entering a contract and provide accurate information. We may request identity, contact, bank-account or other verification information required by law or a regulated partner.
We may refuse, restrict or delay activation when information is incomplete, inconsistent, suspected to be fraudulent or further checks are legally required.
3. Keeping your account secure
- Keep your phone, Access PIN, Transfer PIN, OTPs and recovery information private.
- Never give a PIN or OTP to TopMonie support, an AI assistant or another person.
- Tell us immediately if your device, SIM or credentials may be compromised.
- You are responsible for instructions authenticated with your credentials except where applicable law places responsibility elsewhere.
4. Payment instructions and AI-assisted actions
You may give instructions through forms, buttons, natural-language chat or voice. AI can misunderstand an instruction. Before money moves, review the recipient, amount, fee, total debit and other material details shown for confirmation.
Entering your Transfer PIN or using another approved authentication method authorises the displayed transaction. A message, draft, quote or processing status is not proof of success; the reconciled transaction record controls.
5. Balances, transfers and bill payments
Funds received through TopMonie are subject to the rules of the relevant regulated account provider. Transfers and bill payments may pass through banks, switches, telecommunications providers, billers and payment processors.
A transaction may remain pending while its final outcome is confirmed. Do not repeat it unless the app permits it. We reconcile uncertain outcomes and initiate required reversals or refunds when value was not delivered.
6. Fees and total debit
Before a chargeable transaction is authorised, TopMonie displays the total debit and makes the applicable fee available for review. A fee may include provider costs, statutory charges and a TopMonie service margin.
Fees can vary by service, amount, channel or provider. You can decline a quote before authorising it. We do not add a new fee after authorisation unless required by law and clearly disclosed.
7. Prohibited use
- Fraud, scams, money laundering, terrorist financing or sanctions evasion.
- Transactions involving stolen funds, unlawful goods or another person’s account without authority.
- Attempts to bypass limits, security controls, fees or verification.
- Abuse of promotions, referrals, chargebacks, support or platform infrastructure.
- Any use prohibited by Nigerian law or a service partner’s lawful requirements.
8. Holds, limits and suspension
We or a regulated partner may apply limits, place a lawful hold, reject an instruction or restrict an account to protect users, investigate fraud, manage risk, comply with law or obey a regulator or court.
Where legally permitted, we will explain a restriction and provide a route to challenge it. We will not retain funds merely as a penalty.
9. Availability and third parties
Banks, networks, billers, telecommunications services and other systems can fail or be delayed. We provide reasonable notice of planned maintenance and timely notice of known material delays where practicable.
Third-party services remain subject to their lawful rules. We remain responsible for our own obligations and do not exclude rights that cannot legally be excluded.
10. Liability
Nothing in these Terms excludes liability for fraud, gross negligence, wilful misconduct, breach of a non-excludable statutory duty or consumer rights Nigerian law does not allow us to waive.
Subject to those protections, neither party is liable for indirect or unforeseeable loss. Direct loss is assessed using the transaction, each party’s conduct, provider records and applicable law.
11. Changes and account closure
We may update these Terms for legal, security, product or operational reasons. Material changes will be communicated and may require fresh acceptance.
You may request closure after pending obligations are settled. Some records must remain for fraud prevention, dispute resolution and legal compliance.
12. Complaints, governing law and contact
These Terms are governed by the laws of the Federal Republic of Nigeria. Use in-app support or email topmonie@profynix.com. A formal complaint receives an acknowledgement, tracking reference and applicable timeline.
